California judge slaps down San Francisco food fascists

Children in California will still be able to get toys with their Happy Meals.

A San Francisco judge has dismissed a proposed class-action lawsuit that sought to stop McDonald's Corp. from using toys to market its meals to children in the Golden State. The suit had been filed in late 2010 by Monet Parham, a California mother of two, and The Center for Science in the Public Interest, a consumer advocacy group based in Washington, D.C.

The suit had claimed that the world's biggest hamburger chain was violating consumer protection laws and exploiting children's vulnerability by using toys to lure them to eat nutritionally unbalanced meals that can lead to obesity. The lawsuit did not seek damages.

Hard for me to pick sides on this one; can't stand Olbermann or Gore




Keith Olbermann isn't mincing words in his $70-million lawsuit against Current TV.

Dumped last week by the upstart cable network, Olbermann let loose with a verbal barrage against co-founders Al Gore and Joel Hyatt in a 43-page legal complaint for breach of contract filed Thursday in Los Angeles Superior Court, accusing them of "blackmail" and calling them "dilettantes portraying entertainment industry executives."

Where better to begin than at the mandate itself. The mandate is the probable cause of the law's demise and so the source of the president's rage. In fact, the word "mandate," as argued before the court, appears nowhere in the ACA. What they were litigating was Subtitle F, Part I. Rather than "mandate," its Orwellian title is the "Individual Responsibility Requirement."

We already know that 67% of polled people think the mandate, which compels individuals to buy health insurance or pay a penalty, is unconstitutional. That number might go closer to 100% if people got a look at the law's language.

The ACA calls the act of purchasing insurance a "required contribution." Naturally, many will wonder if they can get out of this. That depends on the meaning of "required contribution," as defined in "Chapter 48—Maintenance of Minimum Essential Coverage, (e) Exemptions, (B) Required contributions:

"For purposes of this paragraph, the term 'required contribution' means . . .: (ii) in the case of an individual eligible only to purchase minimum essential coverage described in subsection (f)(1)(C), the annual premium for the lowest cost bronze plan available in the individual market through the Exchange in the State in the rating area in which the individual resides (without regard to whether the individual purchased a qualified health plan though the Exchange), reduced by the amount of the credit allowable under section 36B for the taxable year (determined as if the individual was covered by a qualified health plan offered through the Exchange for the entire taxable year)."

Jesse Jackson urges wearing hoodies to the polls

Speaking to The Tom Joyner Morning Show on Wednesday, Jesse Jackson said:

"If a white kills a black we revolt, if a black kills a white it's jail time, we kill each other it's Miller time. It's as if somebody has the right to kill us."

Jackson then added "This right wing, we got to win the election, so wear your hoodie, put a voter registration card under your hoodie if you have a hoodie without a voter card you've been Hoodiewinked

Rocket fired from Egypt into Isreal

A rocket fired from Egypt's Sinai desert struck the southern Israeli city of Eilat on Thursday causing no casualties or damage, Israeli police said.
